Labour Market Impact Assessments and/or work permits

A Labour Market Impact Assessment issued by Service Canada is often required to obtain a work permit. Some individuals may be exempt from this requirement depending on your intended occupation and nationality, for example intra-company transferees where an employee is transferred to Canada to provide specialised skills or management to the Canadian branch of the company. I can assist you in obtaining an extension to your status in Canada, and securing implied status so that you may remain in Canada while you or your family members’ applications are in process.

  1. Applying for provincial nomination;

You may secure provincial nomination through one of the provinces of Canada to apply for permanent residence. There are many streams of application to the various provincial nomination programs across the country. I can assist you in navigating the programs and preparing for your application, whether you are a recent graduate, a skilled worker, or an investor.

  1. Applying for permanent residence through sponsorship or Express Entry;

Citizenship & Immigration Canada has undergone drastic changes since January of 2015, in particular with the introduction of Express Entry. I can make an assessment of your skills and characteristics to calculate your points under the program and whether you meet the requirements of the Federal Skilled Worker Program, the Federal Skilled Trades Program, and/or the Canadian Experience Class.

  1. Applying for permanent residence as an investor;

Canada has had a long history of welcoming investor immigrants. The requirements for such mode of immigration have changed drastically in recent years. It is thus advisable to retain experts, such as an immigration lawyer, an accountant, business advisors, in order to make your investment in Canada whether through the federal programme or through provincial streams such as the British Columbia Provincial Nominee Program – Entrepreneur Immigration stream.

  1. Applying for a permanent resident card or citizenship;

Applying for a permanent resident card requires providing proof to Citizenship & Immigration Canada that you have met the residency obligations required of for permanent residents. At this time, the requirement is Canadian residency of 2 out of the 5 years immediately prior to your application. I can advise you whether you have met the requirements and assist you in making your application to renew your permanent resident card.

  1. Appealing a refusal of an application;

Applications are often refused because of oversight of the requirements of a particular application. This may be as simple as forgetting to sign one of the application forms, or more complicated where an officer refuses an application for humanitarian and compassionate relief. I can assist you in obtaining the relevant information to assess why a refusal was made, for example obtaining the notes of the immigration officer who processed your application, and assist you in rectifying the refusal.

  1. Applying for authorization to return to Canada.

Individuals may be deported from Canada for a number of reasons, from criminal activity to failure to meet the residency obligations of a permanent resident. In such cases, an applicant will generally require the consent of Citizenship & Immigration Canada to return to Canada even for tourism. I can assist you in obtaining authorization to return to Canada and advise you as to the legal considerations you need to be aware of in your future immigration plans to Canada.

  1. Applying for Citizenship

If you are on the last rung of the ladder and ready to apply, or have already applied, for Canadian citizenship, I can assist you in making your application so that all necessary information is included in order to facilitate the processing of your application without complication. It is not uncommon for applicants to be requested to attending a citizenship hearing with a judge. Should this apply to you, I can assist you in preparing for the hearing by attending the hearing with you, preparing you and your supporting documents so that you can present your application to the judge in a well organised fashion.
